Welcome to Be Great Golf LLC (“Be Great Golf,” “we,” “us,” or “our”). We operate this website and online store, including all related products, digital content, features, and promotional sweepstakes (the “Services”).

These Terms of Service (“Terms”) govern your use of our Services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you may not use our Services.

SECTION 1 – ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services.

By using our Services, you represent that:

• All information provided is accurate and complete
• You have legal authority to enter into this agreement
• You are a legal resident of the United States or the District of Columbia

SECTION 2 – PRODUCTS & SERVICES

We offer:

• Golf apparel and merchandise (physical products)
• Digital products (instant delivery)
• Promotional sweepstakes opportunities

We do not guarantee that product images will perfectly match actual items due to device differences, monitor calibration, or production variances.

We reserve the right to:

• Modify or discontinue products at any time
• Limit quantities or availability
• Correct pricing or product description errors

SECTION 3 – DIGITAL PRODUCTS (IMPORTANT)

Digital products are delivered instantly upon payment confirmation.

By purchasing digital products, you agree:

• Delivery is considered complete once access is provided
• All digital products are final sale and non-refundable
• Digital products cannot be returned, exchanged, or canceled
• You are responsible for ensuring you have the necessary devices and software to access digital products

SECTION 4 – SWEEPSTAKES & PROMOTIONAL ENTRIES

Sweepstakes and promotional giveaways are a central component of our business. Certain purchases may include promotional sweepstakes entries.

You acknowledge and agree:

• Entries are promotional bonuses, not purchased items
• Entries are allocated at the time of purchase
• Entries are final, non-transferable, and non-reversible
• No purchase is necessary to enter (see Official Rules for free alternative method of entry)
• Each sweepstakes is governed by its own Official Rules, which control in the event of any conflict with these Terms

We reserve the right to:

• Verify eligibility of any entrant or winner
• Disqualify fraudulent, abusive, or suspicious activity
• Modify or cancel any promotion as permitted by applicable law
• Substitute prizes of equal or greater value if a prize becomes unavailable

SECTION 5 – ORDERS

All orders are subject to acceptance by Be Great Golf LLC.

We reserve the right to:

• Refuse or cancel any order at our sole discretion
• Limit quantities purchased per person, per household, or per order
• Verify payment information and identity prior to fulfillment

Orders cannot be modified or canceled once processed.

SECTION 6 – PRICING & PAYMENTS

All prices are listed in U.S. dollars and are subject to change without notice.

You agree:

• To provide accurate, current, and complete billing information
• To pay all charges, including applicable taxes, shipping fees, and any other fees
• That payment must be completed and authorized before order acceptance
• That we are not responsible for currency conversion fees, foreign transaction fees, or fees imposed by your card issuer

SECTION 7 – ALL SALES FINAL (CRITICAL)

ALL SALES ARE FINAL.

Due to the nature of our products and the promotional sweepstakes entries tied to purchases, we do not offer refunds, returns, or exchanges as a matter of policy.

This applies to all purchases, including but not limited to:

• Apparel and physical merchandise
• Digital products
• Promotional sweepstakes entries

Refunds, if any, are issued solely at the discretion of Be Great Golf LLC. In rare cases involving a defective item or shipment of an incorrect item, Be Great Golf LLC may, at its sole discretion, offer a replacement. Replacements are not guaranteed and are evaluated on a case-by-case basis.

To request consideration for a replacement, you must contact us at Team@begreatgolf.com within seven (7) days of delivery, with photographic evidence of the defect or error.

SECTION 8 – CHARGEBACKS & DISPUTES

By making a purchase, you agree not to initiate a chargeback for valid transactions.

If a chargeback is filed:

• Associated promotional sweepstakes entries may be voided
• We reserve the right to dispute the chargeback with supporting documentation
• Future purchases may be restricted or refused
• We may pursue any unpaid balances and associated costs, including attorney fees

If you have a concern about a transaction, please contact us first at Team@begreatgolf.com so we can resolve the matter directly.

SECTION 9 – SHIPPING & DELIVERY

We currently ship within the 50 United States and the District of Columbia only.

Shipping times are estimates only. We are not responsible for delays caused by:

• Carriers (USPS, UPS, FedEx, or other third-party shippers)
• Weather, natural disasters, or other force majeure events
• Incorrect or incomplete shipping addresses provided by you
• External factors outside our reasonable control

Risk of loss and title for products pass to you upon our delivery to the carrier. Lost or stolen packages confirmed as delivered by the carrier are not the responsibility of Be Great Golf LLC.

SECTION 10 – INTELLECTUAL PROPERTY

All content on our Services—including but not limited to logos, images, text, designs, graphics, photography, and the “Be Great Golf” name and brand—is the property of Be Great Golf LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not, without our prior written permission:

• Copy, reproduce, or republish any of our content
• Distribute, sell, or commercially exploit our content
• Modify or create derivative works
• Use our trademarks or branding in any manner that could cause confusion

SECTION 11 – EMAIL & SMS COMMUNICATIONS

Email Marketing. By providing your email address, you consent to receive marketing emails, transactional emails, and other communications from Be Great Golf LLC. You may unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any email or by emailing us at Team@begreatgolf.com.

SMS Marketing. By opting into our SMS program (delivered through our service provider, Klaviyo), you agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS, MMS) from Be Great Golf LLC at the mobile number you provide.

• Consent to receive automated marketing messages is not a condition of any purchase
• Message and data rates may apply
• Message frequency varies
• Reply STOP, END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT to any message to opt out
• Reply HELP for assistance, or contact us at Team@begreatgolf.com

Full SMS Terms & Conditions are set forth in our Mobile Messaging Terms (see Section 19 below) and are incorporated into these Terms by reference.

SECTION 12 – THIRD-PARTY SERVICES

We may use third-party providers to operate our Services, including but not limited to:

• BigCommerce (e-commerce platform)
• Klaviyo (email and SMS marketing)
• Payment processors (such as, PayPal, Apple Pay, Google Pay, stripe)
• Shipping carriers and fulfillment partners

Your use of third-party services may be governed by their respective terms and privacy policies. We are not responsible for the content, services, or practices of any third party.

SECTION 13 – PRODUCT DISCLAIMERS & WARRANTIES

All Services and products are provided “as is” and “as available.”

To the fullest extent permitted by law, Be Great Golf LLC disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Warranties arising from course of dealing or usage of trade

We make no guarantees regarding the availability, accuracy, performance, or reliability of our Services or products. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

SECTION 14 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

Be Great Golf LLC, its officers, directors, employees, affiliates, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Lost profits, lost data, or business interruption
• Any damages arising from your use of, or inability to use, the Services
• Any damages arising from products purchased through the Services

In no event shall our total aggregate liability to you exceed the amount you paid to Be Great Golf LLC in the six (6) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

SECTION 15 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Be Great Golf LLC, its officers, directors, employees, affiliates, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Any content you submit, post, or transmit through the Services

SECTION 16 – TERMINATION

We may suspend or terminate your access to the Services at any time, for any reason, with or without notice, including but not limited to violation of these Terms, fraudulent activity, or abuse of our promotions or sweepstakes.

Upon termination, all rights granted to you under these Terms will cease immediately. Sections that by their nature should survive termination (including but not limited to Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law) shall survive.

SECTION 17 – DISPUTE RESOLUTION (BINDING ARBITRATION & CLASS ACTION WAIVER)

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

17.1 Informal Dispute Resolution

Before initiating arbitration, you and Be Great Golf LLC agree to attempt to resolve any dispute informally for at least sixty (60) days. To begin, you must send a written notice describing the dispute, your contact information, the specific claim, and the relief sought to:

17.2 Binding Individual Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, products purchased, or sweepstakes entries—whether based on contract, tort, statute, or otherwise—that is not resolved through informal dispute resolution shall be resolved by binding individual arbitration.

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be conducted in Travis County, Texas, or by video/telephonic conference at the arbitrator’s discretion.

The arbitrator shall apply the substantive laws of the State of Texas, without regard to conflict-of-law principles. This arbitration agreement is governed by the Federal Arbitration Act (FAA).

17.3 Class Action Waiver

YOU AND BE GREAT GOLF LLC EACH AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void as to that claim.

17.4 Exceptions

Either party may bring an individual action in small claims court for disputes within the court’s jurisdiction. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

17.5 Jury Trial Waiver

TO THE EXTENT ANY DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND BE GREAT GOLF LLC WAIVE ANY RIGHT TO A JURY TRIAL.

17.6 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to the address above within thirty (30) days of first agreeing to these Terms. The notice must include your full name, address, email, and a clear statement that you wish to opt out of arbitration.

SECTION 18 – GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions. Subject to the binding arbitration clause above, any judicial proceeding shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction therein.

SECTION 19 – MOBILE MESSAGING TERMS & CONDITIONS

Be Great Golf LLC offers a mobile messaging program (the “Program”) delivered through our service provider, Klaviyo, Inc. By opting in, you agree to the following:

19.1 Consent to Receive Recurring Automated Messages

You agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS, MMS) from Be Great Golf LLC, including messages that may be sent using an automatic telephone dialing system, to the mobile number you provide. By providing your number, you represent that you are the legally authorized user of that number. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.

19.2 Program Description

Subscribers can expect to receive promotional and marketing messages, including but not limited to product announcements, sales, sweepstakes information, abandoned cart reminders, and special offers.

19.3 Opt-Out

You may opt out of the Program at any time by replying STOP, END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT to any message. You may receive a final confirmation message. The foregoing keywords are the only reasonable methods of opting out. Other phrasings may not be recognized.

19.4 Help

19.5 Disclaimer of Warranty

The Program is offered on an “as-is” basis. Delivery of mobile messages is subject to effective transmission by your wireless carrier and is outside our control. Carriers are not liable for delayed or undelivered messages.

19.6 Age Restriction

You must be at least 18 years old to subscribe to the Program.

19.7 Prohibited Content

You agree not to send any unlawful, harassing, defamatory, threatening, or otherwise objectionable content over the Program.

19.8 Dispute Resolution for SMS Program

Disputes related to the SMS Program are subject to the binding arbitration and class action waiver provisions in Section 17 above.

19.9 State Telemarketing Compliance

To the extent applicable, Be Great Golf LLC endeavors to comply with state telemarketing laws, including but not limited to the Florida Telemarketing Act, the Oklahoma Telephone Solicitation Act of 2022, the Maryland Stop the Spam Calls Act of 2023, and the Virginia Telephone Privacy Protection Act. For purposes of compliance, we may assume your state of residence is associated with the area code of the phone number you provide unless you notify us otherwise in writing.

19.10 Privacy

Your information collected through the Program is handled in accordance with our Privacy Policy and Klaviyo’s privacy practices.

SECTION 20 – CHANGES TO TERMS

We may update these Terms at any time at our sole discretion. The “Last Updated” date at the top reflects when changes were made. Continued use of the Services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

SECTION 21 – SEVERABILITY & WAIVER

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. The failure of Be Great Golf LLC to enforce any right or provision shall not constitute a waiver of such right or provision.

SECTION 22 – ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, Official Rules of any sweepstakes, and any other policies referenced herein, constitute the entire agreement between you and Be Great Golf LLC regarding the Services and supersede any prior agreements.

SECTION 23 - Mobile Terms of Service

The Be Great Golf mobile message service (the "Service") is operated by Be Great Golf (“Be Great Golf”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Be Great Golf’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Be Great Golf through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Be Great Golf. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18666236210 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Be Great Golf mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
